General
The domain name www.pursueit.ae (hereinafter referred to as "Website") and/or the Pursueit mobile applications, jointly referred to as “Platform” is owned by Pursueit FZ LLC (hereinafter referred to as "Pursueit" or “Company”). Please read these Terms of Use fully and carefully before using our platform, the services, features, or content offered by our company. These Terms of use set forth are governed by the following terms and conditions as applicable to the platform including the applicable policies which are incorporated herein by way of reference. Use of the Platform includes but not limited to accessing, browsing, registering, listing, booking and paying on the Pursueit Platform. By mere use of the Website, you are deemed to have read and agreed to these Terms of Use which, constitute Your binding obligations with Pursueit.
These Terms of Use apply to all users of the Services, including, without limitation, users who are contributors of content, information, and other materials or services, registered or otherwise.
The Platform will NOT deal or provide any services or products to any of OFAC (Office of Foreign Assets Control) sanctions countries in accordance with the law of UAE.
Registration.
If you choose to register with us, an account will be created for your use (“Account”) on the Platform and you will be provided with the required Account Information to enable your access to the Account. The term “Account Information” refers to a User identification code, password or any other piece of information which may be provided to you as part of our security procedures. If you access the Platform after logging into any third-party website like Facebook or Gmail, the login information of such third-party account, as the case may be, shall be considered as the Account Information. You must always treat Account Information as confidential and must not disclose it to any third party. Any access to the Platform through your Account shall be considered an access by you or on your behalf and you shall be solely responsible for any activity carried out in, by or through your Account either on the Platform or any other website accessed by you through the Platform.
You represent and warrant that if you are an individual, (i) you are of age as required to enter into a binding contract as is prescribed under the laws of the country in which you reside, or (ii) that if you are registering on behalf of an entity, that you are authorized to enter into, and bind the entity to, these Terms and register for the Services, in accordance with the laws of the country in which you reside. Any person under the age of eighteen (18) years accessing the Platform should do so only under parental guidance. If we change the eligibility criteria to be registered with the Platform and you no longer comply with the new eligibility criteria, as determined by us in our sole discretion, you accept that we may close your Account without any liability for us. You are solely responsible for ensuring that these Terms are in compliance with all laws, rules and regulations applicable to you and the right to access the Services is revoked where these Terms or use of the Services is prohibited and, in such circumstances, you agree not to use or access the Platform or Services in any way.
We have the right to disable your use of the Account Information or any part of it, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms. If you know or suspect that anyone, other than you, knows or has unauthorized access to your Account Information or any part of it, you must promptly notify us by sending us an e-mail at support@pursueit.ae . We are not liable for any losses or other consequences of unauthorized use of your account.
Subject to these Terms and Conditions, we hereby grant you a limited, non-transferrable, non-exclusive, and revocable license to use the Service for your own personal non-commercial use, and not for the use or benefit of any third party.
Services.
The purpose of the Platform is to provide a service to connect you with our Partners, and to facilitate the booking of services to be provided to you by the Partner. We do not make any representations regarding but not limited to the items, services, details, pricing provided to you by our partners. Any pursuant changes to the service including but not limited to rescheduling, extension, lost classes is to be directly agreed with the partner. Your interactions between you and our Partners are strictly between you and our Partners, and we are under no obligation to be involved.
Content.
The Platform contains content which includes Your Information, Pursueit information, Partner information and Information from other users. You agree not to copy, modify, or distribute such content, Platform’s copyrights or trademarks. When You give us any content as part of Your Information, you are granting us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right and license to use, reproduce, , publish, translate, distribute, perform and display such content (in whole or part) worldwide through the Platform as well as on any of our affiliates or partners websites, publications and mobile platform.
Pursueit shall have the right to remove or edit any content that in its sole discretion violates, or is alleged to violate, any applicable law or either the spirit or letter of these Terms of Use. Notwithstanding this right, You remain solely responsible for the content of the materials you post on the website and in your private messages. Please be advised that such Content posted does not necessarily reflect Pursueit views. In no event shall Pursueit assume or have any responsibility or liability for any Content posted or for any claims, damages or losses resulting from use of Content and/or appearance of Content on the Website.
You agree that in the event your listing, posting or your information violates any provision of this Terms of Use, Pursueit shall have the right to terminate and or suspend your membership of the Platform and refuse to provide you or any person acting on your behalf, access to the Website.
You hereby represent and warrant that You have all necessary rights in and to all Content which You provide and all information it contains and that such Content shall not infringe any proprietary or other rights of third parties or contain any libellous, tortious, or otherwise unlawful information. You hereby agree not to hold Pursueit or any of its officers, employees, agents responsible or accountable for any of your listing, postings or information and nor shall We, our officers, employees or agents be liable for any misuse, illegal activity or third party content as most postings, listings or information are generated by various users directly and we do not have any role in the creation, publication or distribution of the posting, listing or information.
We do not guarantee that any Content will be made available on the Site or through the Services. We reserve the right to, but do not have any obligation to, (i) remove, edit or modify any Content in our sole discretion, at any time, without notice to you and for any reason (including, but not limited to, upon receipt of claims or allegations from third parties or authorities relating to such Content or if we are concerned that you may have violated these Terms of Use), or for no reason at all and (ii) to remove or block any Content from the Services.
Intellectual Property
All intellectual property contained on the Platform, including copyrights, patents, trademarks, and other trade secrets are owned by us, our partners, our users or our licensors. Your use of the Site does not grant you any rights, title, or interest in any such intellectual property. This includes any content that you may provide to us, such as feedback regarding the Service. By using the Platform, you hereby assign all rights to us, including the right to use such feedback in any manner we see fit.
Third Party Services
Platform may contain link to third party websites, services or resources on the Internet, and other websites, services or resources may contain links to the Services. When you access third party resources on the Internet, you do so at your own risk. These other resources are not under our control, and you acknowledge that we are not responsible or liable for the content, functions, accuracy, legality, appropriateness or any other aspect of such websites or resources. The inclusion of any such link does not imply our endorsement or any association between us and their operators. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such website or resource.
Rules of Conduct.
As a condition of use, you promise not to use the Services for any purpose that is prohibited by these Terms of Use. You are responsible for all of your activity in connection with the Services.
You shall not (and shall not permit any third party to) either (a) take any action or (b) upload, download, post, submit or otherwise distribute or facilitate distribution of any Content on or through the Service, including without limitation any User Content, that: Infringes any patent, trademark, trade secret, copyright, right of publicity or other right of any other person or entity or violates any law or contractual duty; You know is false, misleading, untruthful or inaccurate; is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another’s privacy, tortious, obscene, vulgar, pornographic, offensive, profane, contains or depicts nudity, contains or depicts sexual activity, or is otherwise inappropriate as determined by us in our sole discretion;
Communications
When you visit this Platform or send e-mails to us, you are communicating with us electronically. You consent to receive communications from Platform or its Partners electronically or other modes of communication as per details provided by you on the Platform. You agree that you give permission to Pursueit and its Partners to communicate with you and that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. You agree that in case there are any changes in any information provided by you to us, including your e-mail address and other contact details, you will be solely responsible to update them regularly. If we send any communication by e-mail, it shall be sent to your e-mail address available on the records created by you on the Platform and it shall be deemed to have been received by you once it is reflected as sent in the outbox of our e-mail id.
Payments, Refunds, Changes and Invoicing
Payment Authorization: By using a payment method, you confirm you are authorized to use it and are solely responsible for any claims arising from its use.
Disputed Transactions: If a transaction is disputed, we will report it to the relevant authorities and may immediately suspend your service access.
Payment Processing: Once you place an order, your chosen payment method will be charged immediately. We are not responsible for any loss or damage during this processing.
Cancellation Policy: We understand unforeseen circumstances may arise. Our cancellation policy varies depending on the type of class you choose:
Bookings with a Fixed Number of Sessions and Validity: These bookings are generally non-cancellable. However, we understand situations may change. You are welcome to contact us to discuss your situation in writing at support@pursueit.ae. While the decision for a refund remains at our discretion, we may offer alternative solutions like credit for future bookings, alternate services or rescheduling sessions within the validity period (subject to availability).
Venue Responsibility: Please note that for both at-home classes and classes held at a location of your choice, securing access to the venue is your responsibility. In these instances, you are booking the services of an instructor or trainer, not the physical space. If you are unable to arrange a suitable venue for your chosen class type, your booking will not be eligible for a refund. We recommend checking venue rules and regulations before booking.
Changes or Postponements: Changes or postponements to the service date and time can be requested up to 24 hours before the scheduled time. Requests received less than 24 hours before will not be permitted. If you fail to inform us at least 24 hours prior and do not attend, the service will be considered completed.
Payment Method Terms: Payment terms are determined by agreements between you and your financial institution. If payment isn't received, you agree to pay all amounts due upon demand.
Transaction Facilitation: We handle all aspects of transaction facilitation for your convenience. This includes collecting 100% of the payment from you on behalf of our partners. We then issue the invoice under Pursueit's name, clearly mentioning the partner who provided the service. You'll receive the invoice immediately upon purchase via email. The invoice will also be available for download from your dashboard for your reference.
Exceptional Payment Methods: In exceptional cases, we may accept payment by account transfer or cheque. However, these are not standard options.
Booking Validity and Session Completion: Unless otherwise specified for a particular class type at the time of booking, all bookings are valid for six (6) months from the date of purchase. All booked sessions must be completed within this validity period. Extensions to the validity period may be considered upon written request, but such extensions require our written agreement to be applicable. Uncompleted sessions will lapse and cannot be rescheduled or retaken after the validity period ends
Country of Domicile:The company is domiciled in the United Arab Emirates and accepts online payments using Visa and MasterCard credit/debit cards in AED.
General Information: These Terms & Conditions ("T&C") govern the purchase, use, and redemption of gift vouchers ("Gift Vouchers") issued by our platform for classes. By purchasing or using a Gift Voucher, you agree to be bound by these T&C.
Description of Gift Vouchers: Gift Vouchers are digital vouchers redeemable for classes offered on our platform. Gift Vouchers can be purchased as gifts for others or for your personal use.
Validity Period: Gift Vouchers are valid for six (6) months from the date of purchase. Please note that expired gift vouchers cannot be used or extended in any way.
Recipient Identification: To redeem a Gift Voucher, recipients must sign up and log in to our platform using the same email address provided by the buyer during purchase. This ensures proper identification and facilitates the seamless redemption process.
Redeeming a Gift Voucher: Recipients can redeem a Gift Voucher by clicking the "Redeem" button in the email containing the Gift Voucher or by entering the voucher code at checkout during class booking.Gift Vouchers can be used for booking any class offered on our platform, including those recommended by the sender or chosen by the recipient.
Partial Payment and Multiple Use: If the chosen class exceeds the Gift Voucher value, recipients can pay the remaining amount using our secure payment options during booking. Gift Vouchers can be used multiple times until the value is depleted or the expiration date is reached, whichever comes first.
Transfer and Refund: Gift Vouchers are non-transferable and non-refundable.Once purchased, Gift Vouchers cannot be exchanged for cash or transferred to another person.
Lost or Stolen Gift Vouchers: We are not responsible for lost or stolen Gift Vouchers. Please treat your Gift Voucher like cash and store it securely.Redeemed Gift Vouchers cannot be replaced.
Class Exclusions and Limitations: Some classes may have specific terms, conditions, or limitations. Please check the class details and terms before booking to ensure compatibility with your Gift Voucher.
Class Unavailability: In the event that a specific class is no longer available for booking, it is the decision of our class partners. While we strive to provide a diverse range of options, availability may change over time. If a chosen class is unavailable,users may choose to book another class of their preference. However, please note that no refund will be offered in such cases, as per our Terms of Service.
Restrictions on Use: Gift Vouchers cannot be used to purchase other Gift Vouchers. They are intended solely for booking classes on our platform
You will be responsible for introduction of any viruses, Trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorized access to the Platform, the server on which the Platform is stored or any server, computer or database connected to the Platform. By breaching this provision, you would commit a criminal offence under the Applicable Law. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Platform will cease immediately.
We will not be liable for any loss or damage caused by a virus, denial-of-service attack, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Platform or your downloading of any Content on it, or on any website linked to it.
You should use your own virus protection software. We cannot and do not guarantee or warrant that files available for downloading from the Platform will be free of infection by viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties.
Termination of Access.
We may terminate your access to all or any part of the Services at any time, with or without cause, with or without notice, effective immediately, which may result in the forfeiture and destruction of all information associated with your membership. If you wish to terminate your Account, you may do so by following the instructions on the Platform or by contacting us at support@pursueit.ae. Any fees paid hereunder are non-refundable. All provisions of these Terms of Use which by their nature should survive termination shall survive termination, including, without limitation, licenses of User Content, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
Terms of Sale.
By purchasing any Services, including Offers, Deals, Discounts, Promotions, Offering, Product or participating in other available programs via the Platform, you agree to the Terms of Use, including, without limitation, the Terms of Sale specified below.
In General. Descriptions of Services, Offers, Activities, and Products advertised on the Site are provided by the Provider or other referenced third parties. We do not investigate or vet Providers. We are also not responsible for any claims associated with the description of the Provider Offerings, Services, or Products. Pricing related to Provider Offerings, Products, Services, and other programs on the Site may change at any time at our sole discretion without notice. A Provider may advertise goods, services, or experiences on the Site, or with respect to Products, Services, or Offerings, supply items to us, that require Provider to have an up-to-date regulatory authorization, license, or certification. Limitation of Liability
To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to the Platform or any content on it including any information related to the Services or the Platform itself, whether express or implied.

If any provision of these Terms of Use is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms of Use will otherwise remain in full force and effect and enforceable. The failure of either party to exercise in any respect any right provided for herein shall not be deemed a waiver of any further rights hereunder

We reserve the right, in our sole discretion, to modify or replace any of these Terms of Use, or change, suspend, or discontinue the Services at any time without notice. While we will endeavor to provide notice of modifications, it is also your responsibility to check these Terms of Use periodically for changes. Force Majeure.
